J40/2115/2010, VAT number: 26582026, as the data controller, processes personal data in accordance with EU Regulation No. 679 of April 27, 2016, concerning the protection of individuals regarding the processing of personal data and the free movement of such data, and the repeal of Directive 95/46/EC (General Data Protection Regulation), as well as with other applicable legal provisions in the field of personal data protection, and with the provisions of this Information Notice.

LOGISTICS CAPITAL EQUIPMENT S.R.L., as a provider of road transport-related services, processes personal data for the following purposes:
(a) For the purpose of providing road transport-related services, LOGISTICS CAPITAL EQUIPMENT S.R.L., as a data controller, processes, through manual and automated means, the following categories of personal data: the name and surname of your company's representative/contact persons, email, phone number, position, address, as well as the name, surname, address, email, phone number of the contact person on behalf of the recipient of the transport/organizer/shipper, information regarding the fiscal code and bank account, geographical information regarding the location of loading and unloading, GPS position in traffic or stationary during the transport, data concerning drivers such as photos or photocopies of ID cards, driver's licenses, name, authorizations, professional certificates, data regarding cargo handlers and load binders.
Except for the data provided directly by you when concluding the service contract, we may collect the above-mentioned data from other sources, such as public databases, our contractual partners, to the extent necessary for the provision of the services you have requested.
We may also collect any data gathered as part of third-party identity compliance evaluations and any other data we process in the context of our commercial relationship according to the provisions of the commercial contracts concluded with our partners.
The processing of these data is carried out under Article 6(1)(b) of the General Data Protection Regulation, as it is necessary for the conclusion and performance of the contract to which your company is a party.
Providing the above-mentioned data is a contractual obligation. Your refusal to provide personal data may result in the inability to provide the services your company has requested from us.
LOGISTICS CAPITAL EQUIPMENT S.R.L. will transfer the personal data processed for the above-mentioned purpose to the following recipients: the contracted transporter for providing the services you have requested, customs authorities, and customs agents, if applicable, and the transport recipient.
The personal data processed for this purpose by the controller LOGISTICS CAPITAL EQUIPMENT S.R.L. will be stored for a minimum period of 3 years from the date of termination of the contract concluded with your company unless data retention for a longer period is necessary to defend the legitimate rights of the controller LOGISTICS CAPITAL EQUIPMENT S.R.L..
(b) For the purpose of ensuring communication with you and managing business relationships with your company, LOGISTICS CAPITAL EQUIPMENT S.R.L., as a data controller, processes, through manual and automated means, the following categories of personal data: identification data (name, surname), contact data (email, phone number) of your company’s representative, identification data (name, surname), email, phone number of contact persons within your company. The processing of these data is carried out under Article 6(1)(f) of the General Data Protection Regulation, as it is necessary for the legitimate interests of the controller, which arise from the need to ensure the quality of the services you request from us.
Providing the personal data processed for this purpose is not mandatory. Your refusal to provide the above-mentioned personal data may result in the inability to ensure the quality of the services you request and, where applicable, the inability to perform the requested services.
The personal data processed for this purpose by the controller LOGISTICS CAPITAL EQUIPMENT S.R.L. will be stored for a minimum period of 3 years from the date of termination of the contract concluded with your company unless data retention for a longer period is necessary to defend the legitimate rights of the controller LOGISTICS CAPITAL EQUIPMENT S.R.L..
Transfer of Data to Third Countries Outside the EU
The data processed by LOGISTICS CAPITAL EQUIPMENT S.R.L. for the above-mentioned purposes will not be transferred to third countries outside the EU or to international organizations.
Rights of Data Subjects Regarding the Processing of Personal Data
In accordance with the General Data Protection Regulation, data subjects have the following rights regarding the processing of personal data:
Right of access to data: The data subject has the right to obtain from the controller confirmation as to whether or not personal data concerning them is being processed and, if so, access to that data, as well as to obtain a copy of the personal data concerning them that is being processed, along with the following information: the purposes of the processing; the categories of personal data concerned; the recipients or categories of recipients to whom the personal data has been or will be disclosed, particularly recipients in third countries or international organizations; the period for which the personal data is expected to be stored or, if this is not possible, the criteria used to determine that period; the rights provided by the General Data Protection Regulation; any available information regarding the source of the data; the existence of automated decision-making, including profiling, and meaningful information about the logic involved and the significance and envisaged consequences of such processing for the data subject.
Right to rectification of data: The data subject has the right to obtain from the controller, without undue delay, the rectification of inaccurate personal data concerning them, as well as the right to have incomplete personal data completed, including by providing a supplementary statement.
Right to erasure of data ("right to be forgotten"): The data subject has the right to obtain from the controller the erasure of personal data concerning them, and the controller has the obligation to erase personal data when one of the reasons stipulated in Article 17 of the General Data Protection Regulation applies.
Right to restrict data processing: The data subject has the right to obtain from the controller restriction of processing when one of the cases stipulated in Article 18 of the General Data Protection Regulation applies.
Right to data portability: The data subject has the right to receive the personal data concerning them and which they have provided to the controller, in a structured, commonly used, and machine-readable format, and the right to transmit those data to another controller, where the processing is based on the data subject's consent or a contract and the processing is carried out by automated means.
Right to object and right not to be subject to a decision based solely on automated processing: The data subject has the right to object, under the conditions provided by Articles 21 and 22 of the General Data Protection Regulation, to the processing of personal data concerning them, including profiling based on those provisions, as well as the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or significantly affects them.
Right to withdraw consent: Where personal data is processed based on the data subject's consent, the data subject has the right to withdraw their consent; the consent may be withdrawn at any time; the withdrawal of consent will not affect the lawfulness of the data processing carried out by the controller before the withdrawal.
Additionally, the data subject has the right to lodge a complaint with the supervisory authority, as well as the right to seek judicial remedies if the rights granted to them under the General Data Protection Regulation have been violated as a result of the processing of personal data by LOGISTICS CAPITAL EQUIPMENT S.R.L.. In Romania, data subjects can address the National Supervisory Authority for Personal Data Processing, located at Bulevardul General Gheorghe Magheru 28-30, Bucharest 010336.
